1. COPYRIGHT AND TRADEMARK

1.1 The name, logo, slogan and website of Mon Joint® (www.monjoint.ch) are protected by copyright and trademark law. Mon Joint® is a registered trademark, created, operated and distributed by Canna Invest SA.

2. ACCEPTANCE OF THE GENERAL CONDITIONS

2.1 By accessing and using our site, regardless of whether you register as a user or not (hereinafter "user"), you agree to be bound by these terms and conditions, which you declare to have read and understood.

2.2 The use of the site is authorized for private use only. Any commercial use, in particular for the purpose of reselling products purchased on the site to third parties, is prohibited, except for resellers expressly authorized by Canna Invest SA.

2.3 By making a purchase on our website www.monjoint.ch you accept the general conditions established between you and Canna Invest SA, owner of the registered trademark "My joint".

2.4 We reserve the right to modify or change these terms and conditions at any time at our own discretion. It is up to you to consult them regularly at www.monjoint.ch/pages/cgv/, in order to keep yourself informed of any changes.

2.5 By using the Site, you acknowledge that the mere posting of revised Terms and Conditions on the Site is sufficient to render you bound by any such change or revision. Your continued use of the Site following any changes means that you accept those changes.

3. YOUR REGISTRATION REQUIREMENTS

3.1 By registering on the Site, you certify and warrant that you are authorized to open an Account in accordance with the Terms and Conditions and that the information you provide during registration is correct and not misleading. An account can only be opened and used by a natural person of legal age, respectively at least eighteen (18) years old.

3.2 As part of your registration, you agree to provide true, accurate, current and complete information about yourself and to maintain and immediately update the registration data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or if Canna Invest SA has reasonable grounds to suspect that you have provided any such information, or if Canna Invest SA otherwise has reason to believe that you have failed to comply with any provision of these terms and conditions, Canna Invest SA has the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof) without providing any reason.

4. ACCOUNT, PASSWORD AND SECURITY

4.1 You are responsible for the quality and confidentiality of the password you choose when you register, and for all activities that occur under your password and account.

4.2 You agree to immediately notify Canna Invest SA of any unauthorized use of your password or account and any other breach of security, and to ensure that you close your account at the end of each session (logout). Canna Invest SA shall not be liable for any loss or damage arising from your failure to comply with these terms and conditions.

5. SITE CONTENT

5.1 Site content www.monjoint.ch is offered to you as is and may not be used, reproduced, distributed, transmitted, broadcast, represented, sold, transferred or exploited in any way other than for consultation and use on the site. For this sole and exclusive purpose, Canna Invest SA authorizes you, on a limited, revocable and non-exclusive basis, to access the site www.monjoint.ch and to use it for private purposes, in accordance with these terms and conditions. 5.2 The user agrees not to violate any legal norms, nor to use the site for any illicit purpose; not to include any false, incomplete or inaccurate information; not to include any virus, Trojan horse, worm, time bomb or any other program designed to damage, adversely affect, intercept or counter any system, data or personal information.

6. PRODUCTS

6.1 The products are available on the site during the periods mentioned. In case of delay in the production process or for other reasons preventing production or delivery, Canna Invest SA may at any time cancel the order and refund the amount already paid by the user, without compensation, interest and any other costs.

7. TERMS AND CONDITIONS OF SALE

7.1 Canna Invest SA is a company specialized in the sale and production of CBD cannabis and products derived from it. This type of business is governed by Swiss federal legislation and Canna Invest SA is obliged to comply with it.

7.2 Canna Invest SA sells its products only on the territory of the Swiss Confederation and only to adults (+18). We remind you that the resale or simple gift to minors is strictly forbidden and punishable by law.

7.3 Canna Invest SA disclaims all responsibility for any registration that does not comply with the terms and conditions of sale of the site www.monjoint.ch.

7.4 Canna Invest SA pays VAT (8%) in accordance with federal legislation.

7.5 Hemp with a total THC content of less than 1% is therefore considered to have no psychotropic effect and can be sold as a product containing tobacco substitutes. Cannabidiol (CBD) is not a narcotic drug under drug law. It is neither listed in the OTStup-DFI nor in the International Convention on Psychotropic Substances (RS 0.812.121.02).

7.6 Les produits contenant des succédanés de tabac destinés à être fumés sont régis par l’Ordonnance sur le tabac (OTab ; RS 817.06). Il est possible de mettre sur le marché des succédanés de tabac à faible teneur en THC (teneur totale en THC < 1 %) contenant du CBD.

7.7 Any person making purchases on the site www.monjoint.ch assumes full responsibility for their actions and their understanding of the laws governing CBD cannabis.

8. PRICE

8.1 The selling prices of the products on the site www.monjoint.ch are indicated in Swiss Francs (CHF).

8.2 The sales prices including value added tax (VAT) applicable on the day of the order are those in force at the time the order is placed by the customer. Canna Invest SA reserves the right to modify its prices at any time.

8.3 The prices indicated do not include shipping costs, which will be invoiced in addition to the price of the products purchased and charged to the buyer. The shipping costs will be indicated before the registration of the order by the customer, according to the mode of delivery chosen by this one.

8.4 The customer may also benefit, during certain periods, from promotional offers on certain products.

These offers will be announced online at www.moinjoint.ch and will be valid during the indicated period and always within the limits of available stocks.

8.5 Price changes will be notified to the customer prior to any order. The prices appearing on the site are applicable within the framework of the on-line sale.

9. TERMS OF PAYMENT

9.1 Secure payment

Terms of payment

The payment methods are as follows: PostFinance, TWINT, bank transfers and payment slips.

Below are the details for each of the above methods:

9.2 PostFinance : We accept PostCard, as well as payments by e-banking. In the latter case, you will need to indicate the name of the company "Canna Invest SA", the IBAN number received in the order validation email and the reference number of your order.

9.3 Bank transfer : This concerns all payments made directly. To do so, you will need to indicate on your payment slip, the name of the company "Canna Invest SA", the IBAN number received in the email validating your order and the reference number of your order.

9.5 Canna Invest SA reserves the right to refuse or cancel the order and/or delivery of a customer, regardless of its nature and level of execution, with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its eyes.

In case of refused payment, the customer will be notified. Once the payment is validated, the order cannot be cancelled.

9.6 Data security is the responsibility of the various service providers with which Canna Invest SA collaborates, such as Swiss Post, TWINT and VISA. They have been chosen for their reliability and solid reputation in this field. If you wish to know all the details, simply visit their respective platforms. Our company is very attached to the anonymity of its customers and the confidentiality of the information received. No fraudulent use of personal data will be tolerated. Let us also note that our site www.monjoint.ch uses an SSL protocol that ensures a high level of security for users and protects against possible attacks.

9.7 Canna Invest SA does not have access to confidential information relating to the means of payment. The information entered is encrypted and transmitted to PostFinance and SIX Payment Services SA in a secure manner, without Canna Invest SA having access to it.

9.8 We also remind you that our products are intended for the Swiss market and for adults. Export or sale to minors is strictly prohibited.

10. DELIVERY AND TRANSPORT

10.1 Packages are generally dispatched within 2 to 4 working days after receipt of payment and verification of payment.

10.2 The products are sent to the delivery address indicated by the user at the time of the order.

10.3 Canna invest SA delivers exclusively in Switzerland.

10.4 Unless otherwise specified at the time of validation of the order, the delivery time is that which is indicated on the site and in the present general conditions.

10.5 Canna Invest SA is not responsible for any delay or problem in delivery. The delivery is validly executed and Canna Invest SA is discharged from any liability upon delivery of the product to the post office or to a carrier. We are not responsible for lost or stolen packages.

10.6 The shipping costs (only for business customers, free private customers), include packaging, handling and postage. They can contain a fixed part and a variable part according to the price or the weight of your order. We advise you to group your purchases in a single order. We cannot group two distinct orders and you will have to pay the shipping fees for each of them. Your order is shipped at your own risk. Special care is taken with packages containing fragile products.

11. FEEDBACK AND EXCHANGES

As a general rule, goods cannot be returned or exchanged.

11.1 The return of delivered goods is possible in certain exceptional cases, which always require the written consent of Canna Invest SA. In this case, the customer will receive a number and address for the return.

11.2 The goods must be returned in the original packaging, complete with all accessories and with the purchase receipt. The return of the goods is at the expense and risk of the customer.

11.3 Canna Invest SA is entitled to demand compensation from the client for any returns not agreed upon.

11.4 Goods returned without the original packaging, incomplete, with missing accessories or to the wrong address will be returned to the customer. In this case, Canna Invest NV will charge the customer a fee for the additional processing.

12. AVAILABILITY OF PRODUCTS

12.1 Our commitment to deliver is void in the event of failure or non-observance of supply deadlines on our part or on the part of our own suppliers, and insofar as this unavailability is not attributable to Canna Invest SA. In case of unavailability of a product, we will inform you as soon as possible.

13. LIMITATION OF LIABILITY

13.1 You expressly acknowledge and agree that Canna Invest SA shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including damages for loss of profit, loss of goodwill, loss of use, loss of data or other intangible losses (even if Canna Invest SA has been advised of the possibility of such damages) resulting from:

- the use of the site or the impossibility of using it,

- the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained, or messages received, or transactions entered into through or from the Site,

- unauthorized access to or modification of your data transmissions,

- statements or conduct of any third party on the Site,

- the effects of the site, of all sites linked to it and of all documents distributed on them,

- defects in products purchased or any other matter relating to the site.

13.2 You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site must be filed within one (1) year after such claim or cause of action arose.

14. GUARANTEE

14.1 Our products cannot be sold at a price higher than the one indicated on the packaging.

14.2 In accordance with the law, you are obliged to notify us of any defects or anomalies affecting the goods delivered to enable us to remedy them. The customer service department is accessible via the Canna Invest SA website. Hidden defects can be challenged even after the products have been put into service or used. Making payments does not constitute a waiver of the complaint.

14.3 In the event of a defect, the purchaser shall be entitled to demand compensation in the amount of the price by withdrawing from the contract or to obtain a replacement. The right of the purchaser to claim damages remains reserved in all cases.

15. TERMINATION

15.1 Canna Invest SA may at any time, with or without notice and at its sole discretion, remove your access to all or part of the Site and deactivate or delete any of your accounts, as well as all information and announcements related to such account and its contents, without liability to you and without having to justify itself.

15.2 You agree that Canna Invest SA may, in its sole discretion, cancel your password, account (or any part thereof) or your use of the Site for lack of activity or if it believes that you have violated any provision of the Terms and Conditions. Canna Invest SA may also remove and delete any product from the site www.monjoint.chCanna Invest SA may also remove and delete any product from the site, cease to provide the site or any part thereof, in its sole discretion and at any time, with or without notice. You agree that any termination of your access to the Site under any provision of these Terms and Conditions may be effected without prior notice and acknowledge and agree that Canna Invest SA may immediately deactivate or delete your account and all related information and/or bar any further access to such files or the Site. You further agree that Canna Invest SA shall not be liable to you or any third party for any termination of your access to the Site.

16. EXEMPTION CLAUSE

16.1 You are accessing the site www.monjoint.ch and use it at your sole risk. The site and its contents are provided as is and as available. Canna Invest SA expressly disclaims, and you hereby waive, all warranties of any kind, whether express or implied, including, without limitation, any implied warranty of fitness for a particular purpose or availability of products.

16.2 Canna Invest SA makes no warranties or representations that; the Site and its contents will meet your requirements; the Site is uninterrupted, current and error-free; the results to be obtained from the use of the Site are accurate or reliable; and any errors in the contents will be corrected.

16.3 Any material downloaded or otherwise obtained through the use of the Site is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material.

16.4 Descriptions and other content on the Site are not intended to constitute advice to be relied upon. No information, whether oral or written, obtained by you from Canna Invest SA or through or on the Site shall constitute a warranty or other obligation not expressly stated in the Terms and Conditions and Canna Invest disclaims any liability arising from reliance on such materials by any visitor to the Site, or by anyone who may be informed of any part of its contents.

17. MODIFICATION OF THE GENERAL CONDITIONS OF SALE

17.1 Considering the possible evolution of the site www.monjoint.chCanna Invest SA reserves the right́ to modify these GTC at any time.

17.2 The new GTC will be available online on the website of Canna Invest SA and will be applicable only to sales made after the modification.

17.3 It is up to the customer to check the existence of new clauses in the GTC, here present at each new order.

18. SALE TO MINORS 

18.1 The minimum age in Switzerland to buy tobacco, or tobacco substitutes - such as CBD cannabis - varies between 16 and 18 years old. To avoid any confusion, Canna Invest SA does not sell CBD cannabis, or any other product, to persons under the age of 18, regardless of the canton in which they originate.

19. COPYRIGHT

19.1 All the content of the website www.monjoint.ch of Canna Invest SA, and its domains, is protected by Swiss copyright and trademark law. It is the exclusive property of Canna Invest SA, or in the case of hosted content provided by third parties, the property of the third party. This includes, without limitation, text, images, videos, audio clips, icons and trademarks.

19.2 Under no circumstances may content be taken, used, modified, edited, exploited, transferred or reproduced without the express written permission of Canna Invest SA. Violation of these terms will result in legal action in accordance with the law.

20. APPLICABLE LAW

20.1 The contract, as regulated by these general terms and conditions, the general terms and conditions themselves and all subsequent orders are governed by Swiss law.

21. FOR

21.1 Any dispute with Canna Invest SA shall be settled before the courts of the jurisdiction of the company's registered office.

22. CONTRAVENTION

22.1 Please notify Canna Invest SA of any violation of the terms and conditions.
