1. COPYRIGHT AND TRADEMARK
1.1 The name, logo, slogan and website of Mon Joint® ( www.monjoint.ch ) are protected by copyright and trademark law. Mon Joint® is a brand, registered, created, exploited and distributed by the company Canna Invest SA.
2. ACCEPTANCE OF THE GENERAL CONDITIONS
2.1 By accessing and using our site, regardless of whether you register as a user or not (hereinafter "user"), you acknowledge being bound by these terms and conditions, which you declare to have read and understood.

3. YOUR REGISTRATION OBLIGATIONS

6. PRODUCTS
6.1 The products are available on the site for the durations mentioned. In the event of a delay in the production process or for other reasons preventing production or delivery, Canna Invest SA may at any time cancel the order and reimburse the user for the amount he has already paid, without compensation, interest and other possible costs.
7. TERMS OF SALE
7.1 Canna Invest SA is a company specializing in the sale and production of CBD cannabis and derivative products. This type of trade is governed by Swiss federal legislation and Canna Invest SA is obliged to comply with it.
7.2 Canna Invest SA sells its products only on the territory of the Swiss Confederation and to adults (+18). We recall, moreover, that the resale or the simple gift intended for minors are strictly prohibited and punishable by law.
7.3 Canna Invest SA disclaims all liability in the event of registration that does not comply with the conditions of sale of the site www.monjoint.ch .
7.4 Canna Invest SA pays VAT (8%), in accordance with federal legislation.
7.5 Hemp with a total THC content of less than 1% is therefore considered to have no psychotropic effect and may be sold as a product containing tobacco substitutes. Cannabidiol (CBD) is not a narcotic within the meaning of narcotics law. This substance is not listed in the OTStup-DFI, nor in the International Convention on Psychotropic Substances (RS 0.812.121.02).
7.6 Products containing tobacco substitutes intended to be smoked are governed by the Tobacco Ordinance (OTab; RS 817.06). It is possible to market low-THC tobacco substitutes (total THC content < 1%) containing CBD.

7.7 Anyone making purchases on the www.monjoint.ch site assumes full responsibility for their actions and their understanding of the laws governing CBD cannabis.
8. PRICE
8.1 The selling prices of products on the www.monjoint.ch website are indicated in Swiss Francs (CHF).
8.2 The selling prices including value added tax (VAT) applicable on the day of the order are those in effect at the time the order is placed by the customer. Canna Invest SA reserves the right to modify its prices at any time.
8.3 The prices indicated therefore do not include shipping costs, these will be invoiced in addition to the price of the products purchased and at the expense of the buyer. The shipping costs will be indicated before the registration of the order by the customer, according to the delivery method chosen by the latter.
8.4 The customer may also benefit, during certain determined periods, from promotional offers on certain products.
These offers will be announced online on the website www.moinjoint.ch and will be valid during the period indicated and always within the limits of available stocks.
8.5 Price changes will be notified to the customer before any order. The prices listed on the site are applicable in the context of online sales.
9. PAYMENT TERMS

The payment methods are: PostFinance, TWINT, bank transfers and payment slips.
Below are the details for each of the above methods:
9.2 PostFinance: we accept the PostCard, as well as payments by e-banking. In the latter case, you will need to indicate the name of the company "Canna Invest SA", the IBAN number received in the email confirming your order and the reference number of your order.
9.3 Bank transfer: this concerns all payments made directly. To do this, you will need to indicate on your payment slip, the name of the company "Canna Invest SA", the IBAN number received in the email confirming your order and the reference number of your order.
9.5 Canna Invest SA reserves the right to refuse or cancel the order and/or the delivery of a client, whatever its nature and its level of execution, with whom there would be a dispute relating to the payment of a previous order or which in his view would present any form of risk.
In case of refused payment, the customer will be notified. Once the payment is validated, the order cannot be cancelled.
9.6 Data security is the responsibility of the various service providers with which Canna Invest SA collaborates, such as Swiss Post, TWINT and VISA. Our company is very attached to the anonymity of its customers and the confidentiality of the information received. No fraudulent use of personal data will be tolerated. 9.7 Canna Invest SA does not have access to confidential information relating to the means of payment. The information entered is encrypted and transmitted to PostFinance and SIX Payment Services SA in a secure manner, without Canna Invest SA having access to it.
9.8 We also remind you that our products are intended for the Swiss market and for adults. Export or sale to minors is strictly prohibited.

10. DELIVERY AND TRANSPORT
10.1 Packages are generally shipped, depending on the type of shipment chosen, within 2 to 4 working days and after receipt of your payment and its control.
10.2 The products are sent to the delivery address indicated by the user at the time of the order.
10.3 Canna invest SA delivers exclusively in Switzerland.
10.4 Unless otherwise specified at the time of validation of the order, the delivery time is that which is indicated on the site and in these general conditions.
10.5 Canna Invest SA is not responsible for any delay or problem during delivery. The delivery is validly executed and Canna Invest SA is relieved of all liability upon delivery of the product to the Post Office or to a carrier. We decline all responsibility in the event of loss or theft of packages.
10.6 Shipping costs (only for professional customers, private customers free), include packaging, handling and postage. They may contain a fixed part and a variable part depending on the price or weight of your order. We advise you to group your purchases into a single order. We cannot combine two separate orders and you will have to pay shipping costs for each of them. Your order is shipped at your own risk. Particular care is taken with parcels containing fragile products.
11. RETURNS AND EXCHANGES
As a general rule, the goods cannot be taken back or exchanged.
11.1 The return of delivered goods is possible in certain exceptional cases, which always require the written agreement of Canna Invest SA. In this case, the customer will receive a number and an address for the return.
11.2 The goods must be returned in the original packaging, complete, with all the accessories and enclosing the purchase receipt. The return of the goods is at the expense and risk of the customer.
11.3 With regard to non-agreed returns, Canna Invest SA is entitled to demand compensation from the client.
11.4 Goods returned without the original packaging, incomplete, with missing accessories or to the wrong address will be returned to the customer. In this case, Canna Invest SA charges the client compensation for the additional processing.
12. AVAILABILITY OF PRODUCTS
12.1 Our delivery commitment is void in the event of failure or non-compliance with supply deadlines on our part or on the part of our own suppliers, and insofar as this unavailability is not attributable to Canna Invest SA. In case of unavailability of a product, we will inform you as soon as possible.
13. LIMITATION OF LIABILITY
13.1 You expressly acknowledge and agree that Canna Invest SA is not liable for any direct, indirect, incidental, special, derivative damage, nor for any exemplary damage, including damage for loss of profit, loss of goodwill, enjoyment, data or other intangible losses (even if Canna Invest SA has been advised of the possibility of such damages) resulting from:
– the use of the site or the impossibility of using it,
– the cost of the purchase of replacement goods and services resulting from any goods, data, information or services purchased or obtained, or messages received, or transactions concluded through the site or from the site,
– unauthorized access to your data transmissions or their modification,
– statements or behavior of any third party on the site,
– the effects of the site, of all sites linked to it and of all documents distributed on them,
– defects in the products purchased or any other matter relating to the site.
13.2 You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or relating to use of the site must be filed within one (1) year after origin of such claim or cause of action.
14. WARRANTY
14.1 Our products cannot be sold at a price higher than that indicated on the packaging.
14.2 In accordance with the law, you are obliged to inform us of any defect or anomaly affecting the goods delivered to enable us to remedy them. The customer service department is accessible via the Canna Invest SA website. Hidden defects can be disputed, even after commissioning or use of the products. Making payments does not constitute a waiver of the complaint.
14.3 In the event of a defect, the buyer has the right to demand compensation corresponding to the value of the price by withdrawing from the contract or obtaining a replacement. The buyer's right to claim damages remains reserved in all cases.
15. TERMINATION
15.1 Canna Invest SA may at any time, with or without notice and in its sole discretion, remove your access to all or part of the site and deactivate or delete any of your accounts, as well as all information and announcements in relation to said account and its content and this, without liability to you and without having to justify it.
15.2 You agree that Canna Invest SA may, in its sole discretion, cancel your password, your account (or any part thereof) or your use of the site for lack of activity or if it believes that you have violated any provision of the general conditions. Canna Invest SA may also withdraw and delete any product from the www.monjoint.ch site , cease to provide the site or any part of it, at its sole discretion and at any time, with or without notice. You agree that any termination of your access to the site, under any provision of these terms and conditions, may be effected without notice and acknowledge and agree that Canna Invest SA may immediately deactivate or empty your account and all information relating thereto. and/or prohibit any further access to these files or to the site. In addition, you agree that Canna Invest SA will not be liable in any way, vis-à-vis you or a third party, for any cancellation of your access to the site.
16. DISCLAIMER

Canna Invest SA expressly disclaims, and you waive, all warranties of any kind, whether express or implied, including, but not limited to, any implied warranties of ability to ensure product quality or availability.
16.2 Canna Invest SA makes no warranty or representation that; the site and its content meet your needs; the site is uninterrupted, updated and error-free; the results that may be obtained from using the site are accurate or reliable; and any content errors will be corrected.
16.3 Any material downloaded or obtained through the use of the site is done so at your option and risk and you will be solely responsible for any damage caused to your computer system, or any loss of data which results from the downloading of such material.
16.4 The descriptions and other content published on the site are not intended to constitute advice on which reliance should be placed. No information, whether verbal or written, obtained by you from Canna Invest SA or through the site or on the site, constitutes a guarantee or other obligation not expressly stated in the general conditions and Canna Invest disclaims all liability arising the reliance placed on these elements by any visitor to the site, or by anyone who may be informed of any part of its content.
17. MODIFICATION OF THE GENERAL CONDITIONS OF SALE
17.1 Given the possible changes to the www.monjoint.ch website , Canna Invest SA reserves the right to modify these GCS at any time.
17.2 The new T&Cs will be available online on the Canna Invest SA website and will only apply to sales made after the change.
17.3 It is up to the customer to check the existence of new clauses in the GCS, here present at each new order.
18. SALE TO MINORS
18.1 The minimum age in Switzerland to buy tobacco, or tobacco substitute - such as CBD cannabis - varies between 16 and 18 years. For the avoidance of doubt, Canna Invest SA does not sell CBD cannabis, or any other product, to persons under the age of 18, regardless of the canton from which they come.
19. COPYRIGHT
19.1 All content of the Canna Invest SA website www.monjoint.ch , and its domains, is protected by Swiss copyright and trademark law. It is the exclusive property of Canna Invest SA, or in the case of hosted content provided by third parties, the property of the third party. This includes, without limitation, texts, images, videos, audio sequences, icons and trademarks.
19.2 Under no circumstances may content be taken, used, modified, edited, exploited, transferred or reproduced without the express written permission of Canna Invest SA. Violating these terms will result in legal action according to law.
20. APPLICABLE LAW
20.1 The contract, as regulated by these general conditions, the general conditions themselves and all subsequent orders are governed by Swiss law.
21.FOR
21.1 Any dispute with Canna Invest SA must be settled before the courts of the forum of the registered office of the company.
22. CONTRAVENTION
22.1 Please notify Canna Invest SA of any breach of the terms and conditions.
